By setting up an account and engaging with the Platform, you consent to abide by these stipulations. The Terms of Use should be read in conjunction with our Privacy Policy.

 

1. Definitions

• “User account" or "Profile" denotes a User's personal space on the Platform.

• "Content" encompasses photos, videos, texts and other digital expressions shared or created within the Platform.

To enjoy the Application, you'll need to create a User account by providing specific personal details, including your phone number, name, age, Username, and user PIN. It's crucial that the information you provide is accurate and genuinely represents you. You are also expected to maintain the confidentiality of your account information. Engaging with our mobile app by creating an account allows us to offer you a personalized and secure experience.

 

Access to our website does not require creating a User account. You may use the website to subscribe to our newsletter, obtain information about the Services, learn more about our company and what we care about. While an account is not necessary for website access, we may ask for certain information if you choose to subscribe to our newsletter or engage with specific features. This information could include your email address and name. As with the mobile app, we emphasize the importance of providing accurate information and respecting the privacy and security of any personal details you share with us.

 

2.2 Age Restrictions

 

The Application welcomes Users aged 13 and above. Users under 13 are not permitted to create an account. In certain jurisdictions, Users between 13 and 16 may require parental consent to use the Application.

 

3. Overview of Services

 

The Friday Social mobile Application is a socialising app made for real life moments, by encouraging uninterrupted time spent with friends or groups and allow sharing of photos taken during these real life moments.

• Check-In Timer: Initiate a session with friends to start the timer, recording the time spent together without distractions. Pauses can be noted for necessary breaks, ensuring the time tracked reflects quality interaction.

• Photo Sharing: Capture and share photos within the session. Everyone checked in gains access to these shared moments, fostering a collective memory of the gathering.

• User Profiles: Create and personalize your User profile. Your contact list integrates with the app, simplifying the process of connecting with friends for sessions.

• Privacy-Centric: Content and data are confined within your own network, aligning with our strong Privacy Policy. The app requires access to your contacts and photo gallery to function as intended.

• Unique Offering: The Application stands out with its multiplayer timer functionality, focusing on enhancing the in-person experience rather than virtual interactions.

• Privacy and Data Use: User data is treated with the utmost respect, accessible only within the User's network. For detailed practices, please refer to our comprehensive Privacy Policy.

• Registration and Account Management: Users are required to register for an account, with options available for profile customization and privacy settings.

• Platform Compatibility: The Application is accessible on both iOS and Android Platforms.

• Updates and Notifications: Important app updates and information will be communicated through notifications and emails.

 

4. Content Reporting and Community Safety

 

4.1 Our Commitment to Safety

 

Friday Social is dedicated to creating a secure and positive environment for all Users. While our Platform is designed for sharing Content within a private network of contacts, we recognize the importance of giving our Users the ability to report Content that violates our community standards, Terms of use, or poses a threat to User safety.

 

4.2 How to Report Inappropriate Content

 

If you encounter Content on our Platform that you believe is illegal, inappropriate, harmful, or violates our Terms of use, we encourage you to report it to us directly or to the Content’s author. However, Friday Social otherwise has no obligation to monitor or review any User Data submitted to the Platform.

 

4.3 Action We Take

 

Upon receiving a report, our dedicated team will review the flagged Content promptly and take appropriate action, which may include removing the Content, suspending the account responsible, or, in severe cases, reporting the activity to law enforcement agencies. We are committed to handling all reports with discretion and respect for User privacy. 

 

4.4 User Responsibility

 

We urge all Users to exercise judgment and respect for others while sharing and interacting with Content. By working together, we can maintain a respectful and safe environment for everyone. By using Friday Social, you commit to following these Terms and applicable laws. This includes not using the Application for unauthorized purposes, respecting others' rights, and not engaging in harmful conduct.

5. Account Termination and Service Availability

 

5.1 Compliance with Terms and Policies

 

You are required to use our Services in accordance with our publicly posted Terms of Use. Failure to comply with these Terms may result in actions against your account, up to and including disabling or suspending your account. Should your account be disabled or suspended in line with these provisions, you are prohibited from creating another account without our express permission. These measures will be executed in accordance with the guidelines outlined in this "Account Termination" section.

 

5.2 Service Modification and Termination

 

We continually strive to enhance our Services, which may involve the expansion, addition, reduction, or removal of Services, features, functionalities, and supported Devices or Platforms. Our Services may occasionally be interrupted or suspended, whether for maintenance, repairs, upgrades, or due to network or equipment failures. Furthermore, we reserve the right to discontinue any part of our Services at any time, potentially as a result of events beyond our control, including natural disasters and other force majeure events.

 

We may at any time, without prior notice, modify, suspend, or terminate your access to our Services for any reason, especially in instances where your actions violate our Terms, or pose a risk or potential legal exposure to us, our Users, or others. Additionally, we reserve the right to deactivate or delete accounts that are inactive for an extended period following registration or thereafter.

 

5.3 Survival of Provisions

 

Notwithstanding the termination of your account or relationship with Friday Social, certain provisions will continue to apply, including "Ownership, Rights, and Licenses," "Liability and Warranty," section, along with any other clauses which, by their nature, should survive termination.

 

5.4 Availability of Our Services

 

Our commitment to improving our Services means their availability may change, with potential expansions, additions, or the discontinuation of certain aspects, features, or support for specific Devices and Platforms. We aim to keep you informed through our FAQ page about these changes, especially as they pertain to widely used Platforms like Android, iPhone.

 

6. Ownership, Rights, and Licenses

 

6.1 Intellectual Property Rights

 

The term "Intellectual Property Rights" as used in these Terms encompasses a wide range of proprietary rights, including but not limited to copyrights, patents, trademarks, trade secrets, domain names, design rights, rights in software (including both source code and object code), and any other similar rights. These rights may be registered or unregistered, include applications for registration, renewals, and extensions, and exist globally.

 

6.2 Ownership and Protection

 

The Platform, along with all Content it hosts and the Intellectual Property Rights therein, are owned by Friday Social, our licensors, or both. These rights are protected by international copyright laws and treaties. We, along with our licensors, reserve all rights to our Intellectual Property Rights, meaning we retain the freedom to use them as deemed appropriate. Access to the Platform and its Content is provided for your browsing and reference only. Unless explicitly allowed by Friday Social, you are not granted any rights to use, modify, reproduce, or distribute any Content from the Platform.

 

6.3 Your Content

 

You retain ownership of the Content and data ("User Data") you create or share on the Platform. By using our Services, you grant Friday Social a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, transferable license to use, process, adapt, display, and distribute your User Data in ways that are in line with our Privacy Policy. 

 

6.4 You affirm that

 

Your User Data is original to you, and you possess the authority to grant us these rights. The use of your User Data on our Platform does not infringe or violate the rights of any third party, including privacy, publicity, and intellectual property rights.

Your User Data complies with these Terms and does not contravene any laws or regulations.

 

6.5 Restrictions on Use

 

Directly replicating, altering, or distributing any Platform Content without our explicit written consent is prohibited. This includes creating derivative works or using the Content for unauthorized purposes. We remain the sole proprietors of our Intellectual Property Rights, and any unpermitted use is strictly forbidden.

 

7. Liability and Warranty

 

7.1 Disclaimer of Warranties

 

Friday Social's Services are provided to you "as is," with all faults and without any guarantees or warranties of any kind, either expressed or implied. We explicitly disclaim any warranties of merchantability, fitness for a particular purpose, non-infringement, and freedom from harmful components such as computer viruses. While we strive to provide accurate and up-to-date information through our Platform, we cannot guarantee that all Content and data are complete, secure, or current. We make no warranties regarding the continuous, error-free operation of our Services, their safety, or their security. The use of our Services, including any reliance on the information provided therein, is solely at your own risk.

 

7.2 Limitation of Liability

 

In no event will Friday Social Parties be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of or related to your use of our Services, regardless of the theory of liability. This includes, but is not limited to, damages or losses caused by reliance on the accuracy of any information, or damages resulting from the use of the Services. If, notwithstanding the other provisions of these Terms, Friday is found liable to you for any damage or loss that arises out of your use of the Services, Friday Social's liability shall in no event exceed the greater of one hundred dollars ($100) or the total amount you have paid to Friday Social in the twelve months prior to the action giving rise to the liability.

 

7.3 Indemnification

 

You agree to indemnify and hold harmless the Friday Social Parties from any claim, demand, loss, or damages, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Services, your violation of these Terms, or your violation of any rights of another. You will assist as fully as reasonably required in the defense of any such claim. Friday Social reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you.

 

7.4 Viruses and Platform Integrity

 

Friday Social does not guarantee that the Platform will be secure, free from bugs, viruses, or other harmful components. You are responsible for implementing sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy your particular requirements for the safety and integrity of your data and Device.

7.5 Availability of the Platform

 

We constantly evolve and improve our Services and may change or discontinue (temporarily or permanently) our Services or any features within them without prior notice. While we aim to ensure the Platform is available at all times, we cannot guarantee uninterrupted access, and we are not liable for any inability to use the Platform or access Content.

 

8. Data Protection

 

Your Personal Data is processed in compliance with relevant data protection laws. Please consult our Privacy Policy for detailed information.

 

9. Terms Modification

 

We reserve the right to update or modify these Terms as necessary to reflect changes in our Services, legal or regulatory requirements, or any other reasons deemed appropriate by us. For changes that affect the mobile application, where you may have a User account, we will notify you of any significant changes through the application's Platform. Such changes will require your acceptance to continue using the mobile application and its Services.

 

For the website, which is primarily used for marketing purposes and does not require a User account for access, any changes to these Terms will be posted on the website. While these changes do not require your explicit acceptance, we encourage you to review the Terms periodically to stay informed about how we are protecting the information you may choose to share with us.

 

10. Governing Law and Jurisdiction

 

We advocate for direct communication as the primary method to resolve any disputes. In the event that issues remain unresolved, these Terms and your use of our Services will be governed by and construed in accordance with the laws of Singapore, without giving effect to any principles of conflicts of law.

 

For our international Users, it is important to note that you may have rights under the consumer protection laws of your own jurisdiction. We respect these rights and will not seek to avoid such consumer protections.

 

Should a dispute arise that cannot be resolved through direct communication, we are committed to seeking amicable resolutions through mediation or arbitration in Singapore, as a first recourse. If litigation is necessary, the dispute shall be submitted to the exclusive jurisdiction of the courts of Singapore, unless mandatory applicable laws specifically require a different procedure.

 

This approach ensures that both local and international Users have a clear understanding of the legal framework governing their use of our Services, while also emphasizing our commitment to fair and accessible dispute resolution.

 

11. Linking to the Platform

 

You may link to the homepage of the Platform from another website provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not present or establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. We reserve the right to withdraw linking permission without notice and to require you to immediately remove any link to the Platform at any time, and you shall immediately comply with any request by us to remove any such link.

 

12. Force Majeure

 

We will not be liable for any delay, interruption or failure in the provisioning of Services if caused by acts of God, declared or undeclared war, fire, flood, storm, slide, earthquake, power failure, the inability to obtain equipment, supplies or other facilities that are not caused by a failure to pay, labor disputes, or other similar events beyond our control that may prevent or delay service provisioning.

We may amend or update these Terms. We will provide you notice of material amendments to our Terms, as appropriate, and update the "Effective Date" at the top of our Terms. Your continued use of our Services confirms your acceptance of our Terms, as amended. We hope you will continue using our Services, but if you do not agree to our Terms, as amended, you must stop using our Services by deleting your account.
